These terms explain the agreement between you and us when you use Scattered. Please read them — they're written to be as plain as possible. By creating an account or using the app, you agree to them.
1. About us
Scattered is provided by Elements4 Ltd, registered in England and Wales (company number 09790962), registered office Barn 2b Dunston Business Village, South Courtyard, Dunston, Stafford, ST18 9AB, United Kingdom. Contact: support@elements4.io.
2. Using Scattered
- You must be 16 or over to create an account.
- Keep your sign-in details safe. You're responsible for what's done with your account.
- You can explore the map and leave memories on pins you've been invited to without an account. Placing a pin or asking to see someone's pin needs an account.
3. What you share
Everything you add — pins, photos, words and memories — remains yours. So that we can run the app, you give us permission to store it, display it and send it to the people it's meant for (as explained in our privacy policy). This permission ends when you delete it, except for copies already shared with others through the app, or kept briefly in backups.
When you add something, you confirm that:
- you have a genuine connection to the person you're remembering, or the family's blessing;
- you own the photos you upload, or have permission to use them;
- it's truthful and respectful, and doesn't include private information about living people that they wouldn't want shared.
Please don't use Scattered to post anything unlawful, hateful, harassing, sexually explicit or misleading, to impersonate anyone, to advertise, or to try to get around the app's security or payment.
4. Pins that are shared or disputed
Grief can be complicated, and more than one person may feel a connection to someone. If you believe a pin shouldn't be there, is inaccurate, or uses your photos without permission, email support@elements4.io. We'll look into it sensitively and may edit, hide or remove content, or suspend an account, where we reasonably believe these terms have been broken or someone is being harmed. Where we can, we'll explain why.
Pin owners approve the memories left on their pins and decide who else can see them. We don't check content before it appears, but we act on reports.
5. Paying for pins
- Exploring the map, viewing pins you've been invited to and leaving memories are free.
- Placing a pin is a one-off payment per pin, shown in the app before you pay. There's no subscription. Each payment gives you one pin.
- Moving a pin is free: if you delete a pin, you get that pin back to place again.
- Payments are taken by Apple (App Store) or Google (Google Play) and are also covered by their terms.
- Early-access offer: while it lasts, the first 750 people to reach the payment step can place their first pin free. It's limited to one per person, and we may end it once all 750 are claimed or if it's being misused.
- If you delete your account, any pins you've paid for but not yet placed are lost.
6. Refunds and your consumer rights
Because a pin is digital content that's delivered straight away, you agree when you buy that it's supplied immediately, which means the usual 14-day cancellation period doesn't apply once you've bought it. This doesn't affect your legal rights: if something you've paid for doesn't work as described, you're entitled to a repair, replacement or refund. Refunds are handled by Apple or Google — see our support page for how to ask — and we'll help if you get stuck.
7. Scattering ashes guidance
The scattering ashes advice in the app is general information to help you get started. It's not legal advice, and rules vary by place and change over time. Always check with the landowner, local council or relevant authority before scattering ashes. Placing a pin doesn't give anyone permission to visit or access a location.
8. The service
We work hard to keep Scattered running and your memories safe, but we can't promise it will always be available or free of faults. We may update the app, change or remove features, or — if we ever had to — stop providing it. If we decide to close Scattered, we'll give you at least 90 days' notice and a way to download what you've added.
We recommend keeping your own copies of photos that matter to you.
9. Our responsibility to you
We're responsible for loss or damage you suffer that's a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We're not responsible for loss that wasn't foreseeable, for business losses, or for content added by other users. Nothing in these terms limits our liability where the law doesn't allow it, including for death or personal injury caused by our negligence, or for fraud.
10. Ending this agreement
You can stop using Scattered and delete your account at any time from the account menu in the app. We may suspend or close an account that seriously or repeatedly breaks these terms.
11. Changes to these terms
We may update these terms, for example when we add features or the law changes. If a change is important, we'll let you know — by email or in the app — before it takes effect. If you don't agree, you can delete your account.
12. If you use an iPhone
These terms are between you and Elements4 Ltd, not Apple. Apple isn't responsible for Scattered or its content, has no obligation to provide support or maintenance for it, and isn't responsible for any claims relating to it (including product liability, legal or regulatory claims, or third-party intellectual property claims). If the app fails to meet any applicable warranty, you can tell Apple and it will refund the purchase price of the app (if any); beyond that, Apple has no warranty obligation. You confirm that you're not in a country subject to a US Government embargo and aren't on a US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Where these terms and Apple's Standard Licensed Application End User License Agreement differ, these terms apply.
13. Law and disputes
These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you can also bring proceedings in your home courts. If you have a complaint, please contact us first — we'll do our best to resolve it.
